How Statutory Maternity Pay Works in the UK

What is Statutory Maternity Pay?

Statutory Maternity Pay (SMP) is the minimum amount your employer must pay you during maternity leave. It runs for up to 39 weeks and is split into two phases — a higher rate for the first six weeks, then a flat rate for the remaining 33 weeks.

Who Qualifies for SMP?

You qualify if you have been employed by the same employer for at least 26 weeks by the end of the 15th week before your due date, and your average weekly earnings are at least £123. If you do not qualify, you may be entitled to Maternity Allowance instead.

The Drop-Off at Week Seven

At week seven, your pay drops from 90% of your average weekly earnings to the flat rate of £187.18/week. For someone earning £35,000/year, that is a drop from around £606/week to £187/week.

Enhanced Maternity Pay

Many employers top up SMP beyond the statutory minimum. It might mean full salary for the first three or six months, or half pay for a period. Always check your employment contract and speak to HR.

How is my average weekly earnings calculated for SMP purposes?+
Your AWE is calculated based on your earnings in the eight weeks immediately before the 15th week before your due date. This includes your basic salary plus any regular bonuses, overtime or commission paid in that period.
Can I work during maternity leave without losing my SMP?+
You can work up to 10 Keeping in Touch (KIT) days during your maternity leave without losing your SMP. Any work beyond 10 KIT days will end your SMP for that week.
What if I am self-employed or a contractor?+
If you are self-employed, you will not qualify for SMP as it is paid by employers. You may be eligible for Maternity Allowance of up to £187.18/week for 39 weeks. Contractors working through a limited company may qualify for SMP as a director-employee — speak to your accountant.
What happens if I decide not to return to work?+
You are not required to repay Statutory Maternity Pay if you decide not to return to work. However, if your employer has paid enhanced maternity pay, they may require you to repay the enhancement. Check your contract for the specific terms.
Is Shared Parental Leave pay the same as SMP?+
Statutory Shared Parental Pay is paid at the same flat rate as SMP — £187.18/week (2025/26). It does not include the higher 90% phase that applies to the first six weeks of SMP.
