Important Things to Know
Weeks 40–52 are unpaid. If you take the full 52-week year, weeks 40–52 receive no statutory pay. Some employers enhance this — check your contract.
SMP is taxable. The amounts shown are gross. You will pay income tax and National Insurance on your SMP — your net pay will be lower than shown.
Eligibility check. To qualify for SMP you must have been employed for at least 26 weeks by the 15th week before your due date, and earn at least £123/week on average.
SMP rates update annually. The flat rate of £187.18/week applies from April 2025. Check gov.uk for the latest rates if calculating for a future tax year.
How Statutory Maternity Pay Works in the UK
What is Statutory Maternity Pay?
Statutory Maternity Pay (SMP) is the minimum amount your employer must pay you during maternity leave. It runs for up to 39 weeks and is split into two phases — a higher rate for the first six weeks, then a flat rate for the remaining 33 weeks.
Who Qualifies for SMP?
You qualify if you have been employed by the same employer for at least 26 weeks by the end of the 15th week before your due date, and your average weekly earnings are at least £123. If you do not qualify, you may be entitled to Maternity Allowance instead.
The Drop-Off at Week Seven
At week seven, your pay drops from 90% of your average weekly earnings to the flat rate of £187.18/week. For someone earning £35,000/year, that is a drop from around £606/week to £187/week.
Enhanced Maternity Pay
Many employers top up SMP beyond the statutory minimum. It might mean full salary for the first three or six months, or half pay for a period. Always check your employment contract and speak to HR.
